1. Acceptance of Terms

By accessing or using KyberCheck ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

KyberCheck is a quantum vulnerability scanning platform that analyzes source code repositories for cryptographic implementations that may be vulnerable to attacks from quantum computers. The Service provides automated detection of quantum-vulnerable algorithms, security assessments, and recommendations for migration to post-quantum cryptography.

3. IMPORTANT DISCLAIMERS

3.1 No Guarantee of Complete Vulnerability Detection

KyberCheck DOES NOT guarantee 100% detection of all quantum-vulnerable cryptographic implementations.The Service uses pattern-matching and heuristic analysis which may not identify all vulnerabilities, including but not limited to: obfuscated code, dynamically generated cryptographic calls, vulnerabilities in third-party dependencies, or novel cryptographic implementations. Users should not rely solely on KyberCheck for security assessments.

3.2 Quantum Computing Attacks

KyberCheck and its operators are NOT responsible for any damages, losses, or security breaches resulting from attacks by quantum computers. This includes, but is not limited to:

  • Data breaches caused by quantum cryptanalysis
  • Decryption of previously encrypted data ("harvest now, decrypt later" attacks)
  • Compromise of digital signatures or authentication systems
  • Financial losses resulting from cryptographic failures
  • Any damages arising from undetected vulnerabilities

The emergence and capabilities of quantum computing are inherently unpredictable. Users acknowledge that no service can provide complete protection against quantum computing threats.

3.3 Service Limitations

The Service is provided "AS IS" without warranties of any kind. We do not warrant that:

  • The Service will be uninterrupted or error-free
  • All security vulnerabilities will be detected
  • Recommendations will be suitable for your specific use case
  • Implementation of recommendations will prevent all security breaches

4. User Responsibilities

Users of the Service agree to:

  • Use the Service only for lawful purposes
  • Only scan repositories they own or have explicit permission to analyze
  • Not attempt to circumvent any security measures of the Service
  • Not use scan results to exploit vulnerabilities in third-party systems
  • Maintain the confidentiality of their account credentials
  • Conduct independent security assessments in addition to using the Service

5. Intellectual Property

Users retain all rights to their source code. KyberCheck does not claim ownership of any code analyzed through the Service. Scan results and reports are provided for the user's internal use and may not be redistributed commercially without permission.

6. Data Handling

KyberCheck does NOT store your source code. We analyze repository content in-memory and store only metadata and scan results. For complete details on data handling, please review our Privacy Policy.

7. Subscription and Billing

Paid subscriptions are billed in advance on a monthly or annual basis. Refunds are provided at our discretion. Users may cancel their subscription at any time, with access continuing until the end of the current billing period.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KYBERCHECK AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify and hold harmless KyberCheck and its operators from any claims, damages, or expenses arising from your use of the Service, violation of these terms, or infringement of any third-party rights.

10. Modifications

We reserve the right to modify these Terms of Service at any time. Material changes will be notified via email or through the Service. Continued use after changes constitutes acceptance of the modified terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
